It’s a Hard Knock Life for Them: Can Next of Kin File Suit in NHL Concussion Claims?

hockey skatesThe NHL is seeking to have certain concussion claims brought by wives and next of kin dismissed. A lawsuit seeking compensation from the league for medical and household care was filed on January 15 in U.S. federal court. The NHL has now filed a motion to dismiss for lack of standing, stating that the claims seek compensation for wrongful death, survival and loss of consortium, yet no named plaintiff has suffered a wrongful death. Additionally, the league asserts that no plaintiff is the spouse of an affected player that has suffered a loss of comfort and companionship as a result.
